These Terms of Service (“Terms”) govern your access to and use of the website Strezzy.com (the “Site”), mobile applications, and any related services (collectively, the “Services”) operated by Strezzy (referred to as “we,” “us,” “our,” or “Strezzy”). By accessing, browsing, or using the Services, or by creating an account, you agree to be bound by these Terms. If you do not agree, do not use the Services.

We may update these Terms at any time by posting the revised version on the Site. Your continued use after changes constitutes acceptance. Check back periodically.

1. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) and capable of entering binding contracts to use the Services. By using the Services, you represent that you meet these requirements. Accounts for minors are prohibited.

2. Account Registration

To access certain features (e.g., purchasing or managing orders), you may be required to create an account. You agree to provide accurate, current information and keep it updated. You are responsible for maintaining the confidentiality of your login credentials and all activities under your account. Notify us immediately of any unauthorized use.

3. Service Structure & Fulfillment Types

Strezzy operates as both an e-commerce store and a curated marketplace platform connecting buyers (“Users”) with independent third-party suppliers, print-on-demand (POD) partners, and fulfillment services (including via Shopify Collective).

  • Print-on-Demand & Third-Party Products: Many of our products are custom made-to-order (Print-on-Demand) or fulfilled directly by independent third-party suppliers. For these products, manufacturing or fulfillment begins upon order placement. As detailed in our Return Policy, all Print-on-Demand and third-party items are Final Sale and non-returnable unless they arrive damaged, defective, or incorrect.
  • Items Fulfilled Directly by Strezzy.com: For items managed and shipped directly from Strezzy inventory, we act as the direct seller and honor returns within 30 days of delivery in accordance with our Return Policy.

4. User Conduct and Content

You may not:

  • Violate laws, infringe intellectual property rights, or post harmful/malicious content.
  • Use automated tools (bots, scrapers) without permission.
  • Harass, impersonate, or spam others.
  • Post false or misleading information.

You grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute any content you upload/post (e.g., product reviews) for operating and promoting the Services.

We reserve the right to remove content or suspend accounts for violations, without prior notice or liability.

5. Purchases, Payments, and Final Sale Terms

  • Prices and product availability are subject to change without notice.
  • We process payments via secure third-party payment providers (e.g., Shopify Payments, Apple Pay, Shop Pay). You authorize charges to your selected payment method.
  • Taxes, duties, and shipping costs are calculated at checkout and are your responsibility.
  • Returns & Sales Finality: All Print-on-Demand and third-party fulfilled sales are Final Sale. Returns or exchanges for change of mind or sizing issues are not permitted for Print-on-Demand products. Replacements or refunds are provided solely for defective, damaged, or misprinted items reported within 14 days of delivery. For items directly fulfilled by Strezzy, 30-day returns apply per our Return Policy.

6. Intellectual Property

The Services, including site design, graphics, apparel designs, logos, text, and software, are owned by us or our licensors and are protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-transferable license to access the Site for personal, non-commercial use only.

You may not copy, reproduce, modify, distribute, or create derivative works from our content or designs without express written permission.

If you believe content on our Site infringes your IP rights, please submit a DMCA notice to support@strezzy.com with complete details.

7. Disclaimers and Limitation of Liability

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED OPERATION.

To the fullest extent permitted by law:

  • We are not liable for indirect, incidental, consequential, special, punitive, or exemplary damages (e.g., lost profits, data loss, business interruption), even if advised of the possibility.
  • Our total liability from any claim shall not exceed the greater of (i) $100 or (ii) amounts you paid us in the 12 months preceding the claim.
  • We disclaim liability for third-party supplier actions, shipping carrier delays, third-party site links, or events beyond our reasonable control (force majeure).

8. Indemnification

You agree to indemnify, defend, and hold harmless Strezzy, our affiliates, officers, directors, employees, and agents from claims, losses, liabilities, damages, and costs (including reasonable attorneys' fees) arising from your use of the Services, your violation of these Terms, or your infringement of any third-party rights.

9. Dispute Resolution – Mandatory Arbitration and Class Action Waiver

PLEASE READ CAREFULLY – AFFECTS YOUR LEGAL RIGHTS.

Any dispute, claim, or controversy arising out of or relating to these Terms, the Services, or your use (a “Dispute”) shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules (or JAMS if AAA is unavailable), in Los Angeles County, California.

  • Jury Trial Waiver: You and Strezzy waive the right to a jury trial or court proceeding (except small claims court for qualifying individual claims).
  • Class Action Waiver: Disputes must be brought individually only — no class actions, consolidated proceedings, or representative actions. You waive any right to participate as a class member.
  • Arbitration Opt-Out: You may opt out of arbitration within 30 days of first agreeing to these Terms by emailing support@strezzy.com with the subject line “Arbitration Opt-Out” along with your full name and account details.

Governing Law: These Terms are governed by California law, without regard to conflict of law principles, except where federal law applies.

10. Termination

We reserve the right to suspend or terminate your access to the Site or Services at any time for violations of these Terms, suspected fraud, or at our sole discretion, without notice or liability.

11. Miscellaneous

  • Entire Agreement: These Terms, alongside our Privacy Policy and Return Policy, constitute the complete agreement between you and Strezzy.
  • Severability: If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full effect.
  • No Waiver: Our failure to enforce any right or provision does not constitute a waiver of future enforcement.
